2) Terms of Service

2.1 Scope

These Terms govern your use of optitechautomation.co.uk (the “Website”) and any services provided by OptiTech Automation, including marketing strategy, advertising campaign setup and management, landing page content, and related implementation (the “Services”).

2.2 Who We Work With

We provide Services to businesses (B2C and selected B2B). By engaging us you confirm you’re authorised to act for your business.

2.3 Proposals, Fees & Payments

Proposals. We may issue a written scope/quote (“Proposal”) valid for 30 days.

Fees. Build/setup fees and ongoing management are separate from media spend (Google/Meta, etc.), which you pay directly to the platform unless otherwise agreed.

Invoices. Payable within 7 days of issue. Late payment may incur interest per the Late Payment of Commercial Debts (Interest) Act 1998.

Expenses. Pre-approved expenses are recharged at cost.

2.4 Your Responsibilities

Provide timely access to accounts (ads/analytics/CRM/domains), approvals, and accurate information; comply with applicable laws and platform policies; handle and follow up leads promptly.

2.5 Our Responsibilities

We will perform Services with reasonable care and skill, provide reporting aligned to agreed KPIs (e.g., leads, qualified calls, booked appointments), and comply with data protection law as Controller or Processor as applicable (see Privacy).

2.6 Pay-on-Proof Pilot (optional model)

If agreed in writing:

Duration: 30–45 days from first campaign go-live.

Discount: Setup/management fees may be discounted during the Pilot.

Baseline: We’ll agree target metrics (e.g., cost-per-lead, number of booked appointments).

Proof & Transition: When baseline is met and confirmed in writing, you’ll provide a testimonial/case quote and the engagement moves to standard pricing.

No guarantee: Results vary by market, competition, budget, and your lead handling.

2.7 Intellectual Property

You own your brand assets and first-party data. We retain ownership of our pre-existing tools, templates, and know-how. Deliverables are licensed to you for internal business use. Campaigns built in your ad accounts remain in your accounts.

2.8 Acceptable Use

Do not use the Services for unlawful, misleading, discriminatory, or harmful activity. We may suspend Services to address legal or platform-policy risks.

2.9 Confidentiality

Non-public information shared by either party must be kept confidential and used only to perform the contract, except where disclosure is required by law.

2.10 Warranties & Disclaimers

Services are provided “as is”. We don’t guarantee specific commercial outcomes.

2.11 Liability

Nothing limits liability for death/personal injury caused by negligence, fraud, or other liabilities that cannot be limited by law. Otherwise, our total liability is limited to the fees paid in the 3 months preceding the event giving rise to the claim. We are not liable for lost profits, revenue, data, or indirect/consequential loss.

2.12 Term & Termination

Either party may terminate with 30 days’ notice, or immediately for material breach not cured within 7 days. Accrued fees remain payable. On termination we will hand over agreed assets and remove access.

2.13 Force Majeure

Neither party is liable for delays caused by events beyond reasonable control.

2.14 Governing Law

These Terms are governed by the laws of England & Wales. Courts of England & Wales have exclusive jurisdiction.

2.15 Changes to Terms

We may update these Terms. Material changes will be posted here with a new “Last updated” date.

3) Privacy Policy (UK GDPR)

3.1 Who We Are

For Website visitors and our own marketing, OptiTech Automation (sole trader) is the Data Controller. For client work where we process personal data on your behalf (e.g., leads within your CRM), we act as a Processor and you are the Controller; a Data Processing Agreement (DPA) applies.

3.2 Data We Collect

Website usage: IP address, device/browser info, pages viewed, referring URLs, cookies/SDK data.

Enquiries: name, business name, email, phone, service interest, message.

Client work (as Processor): advertising account IDs, analytics IDs, campaign and conversion data, CRM contacts, call recordings if enabled.

Communications & admin: emails, meeting notes, proposals, invoices.

We do not intentionally collect special category data (e.g., health data). Clients in medical fields must not send patient data through our channels or landing pages unless we have a signed DPA and compliant tools in place.

3.3 Purposes & Lawful Bases

Provide and manage Services (contract; legitimate interests)
Respond to enquiries (contract; legitimate interests)
Analytics and Website performance (consent where required; legitimate interests)
Direct B2B marketing to business contacts (legitimate interests; you can opt out anytime)
Legal/compliance (legal obligation; legitimate interests)

3.4 Sharing

We use trusted service providers for hosting, analytics, communications, file storage, project management, and (where applicable) CRM/automation and call tracking. We require appropriate contracts and only share what’s necessary.

3.5 International Transfers

Where data leaves the UK/EEA, we rely on adequacy regulations or Standard Contractual Clauses with supplementary measures where appropriate.

3.6 Retention

Website analytics: 13 months (tool default unless configured otherwise).
Enquiries (email/forms): 24 months from last contact.
Client project data: contract term + 12 months.
Invoices/financial records: 6 years (legal requirement).
Minimal records may be kept to comply with law or resolve disputes.

3.7 Your Rights

You have rights to access, rectify, erase, restrict, object, and data portability; and to withdraw consent (where processing relies on consent). To exercise rights, contact hello@optitechautomation.co.uk. You can complain to the Information Commissioner’s Office (ICO) at ico.org.uk.

3.8 Security

We apply reasonable technical and organisational measures: access controls, encryption in transit, least-privilege access, MFA on critical systems, and vendor reviews.

3.9 Children

This Website is not intended for children under 16. This website is not intended for children between 16 and 18 without a supervision by an adult. Not for under 16.
