This Acceptable Use Policy ("AUP") forms part of your agreement with OptiTech Automation. It is incorporated into the Business Owner Terms and Conditions (Clause 5.5) and the Worker Terms. By accessing or using the platform you agree to comply with this AUP. OptiTech Automation is operated by Cristian Moise-Putanu, sole trader, Torquay, Devon, England.

1. Who this policy applies to

This AUP applies to every person who accesses the OptiTech Automation platform in any capacity — Business Owners, Workers, and CMS Editors.

This policy applies to three groups of users:

Business Owners: Trade businesses (plumbers, electricians, gas engineers, and other tradespeople) that subscribe to OptiTech Automation to manage bookings, workers, and customers. Your use of the platform is also governed by the Business Owner Terms and Conditions, into which this AUP is incorporated at Clause 5.5.
Workers: Employees and self-employed persons engaged by a Business Owner who access the OptiTech Automation worker app to manage job assignments and schedules. Your use of the platform is also governed by the Worker Terms.
CMS Editors: Persons granted access to the OptiTech Automation content management system (the "/cake" admin console) to publish or edit content on behalf of a Business Owner. CMS Editor access is granted solely to authorised personnel of the subscribing Business Owner.

References to "the platform" in this AUP include optitechautomation.co.uk, app.optitechautomation.co.uk, the worker mobile app, the admin console, and all associated APIs, integrations, and communications channels operated by OptiTech Automation.

2. Prohibited activities

The following activities are strictly prohibited on the platform. The list is not exhaustive — conduct that is harmful, unlawful, or contrary to the spirit of this policy will be treated as a breach even if not explicitly named.

You must not use the platform to do, or attempt to do, any of the following:

2a. Fraud and false information

Submit false, fraudulent, or fabricated bookings, payments, invoices, or business information on or through the platform.
Impersonate any person, business, regulatory body (including Gas Safe Register, NICEIC, NAPIT, or any other competent person scheme), or authority.
Misrepresent your trade qualifications, certifications, accreditations, or insurance coverage within the platform.

2b. Safety and regulatory compliance

Use the platform to schedule, arrange, or record gas fitting or gas appliance work by any person who is not registered with Gas Safe Register, in breach of the Gas Safety (Installation and Use) Regulations 1998. Gas work scheduled through the platform must only be assigned to Gas Safe registered workers.
Use the platform to schedule, arrange, or record notifiable electrical installation work in a dwelling by any person who is not a member of a government-approved competent person scheme (such as NICEIC or NAPIT) or who has not obtained the required building notice or completion certificate, in breach of Building Regulations 2010 Part P.
Engage workers through the platform without first conducting right-to-work checks as required by the Immigration Act 2014. It is the Business Owner's legal obligation to verify that every worker engaged through the platform has the right to work in the United Kingdom before work commences.

2c. Conduct

Harass, threaten, intimidate, bully, defame, or discriminate against workers, customers, OptiTech Automation staff, or any other person in connection with use of the platform, on any ground including age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, or sexual orientation (Equality Act 2010).
Publish, transmit, or facilitate content that is defamatory, grossly offensive, obscene, or that incites hatred or violence — including in job notes, customer communications, or CMS-published content (Defamation Act 2013; Public Order Act 1986).

2d. Platform security and access

Share your platform credentials (username, password, or API keys) with any person not authorised to access your account, or allow unauthorised access to the platform through your account.
Attempt to access, read, copy, alter, or delete data belonging to another Business Owner, worker, or customer — including by exploiting API endpoints, database queries, or any other technical means.
Probe, scan, or test the vulnerability of the platform or any connected system without prior written authorisation from OptiTech Automation.
Upload, transmit, or introduce to the platform any malicious code, virus, worm, trojan, ransomware, spyware, or any other harmful or disruptive software or script.
Use automated scraping tools, bots, crawlers, or scripts to extract data from the platform at a rate or volume beyond normal human use, without prior written consent from OptiTech Automation.
Reverse-engineer, decompile, or disassemble any part of the platform, except to the extent expressly permitted by section 50C of the Copyright, Designs and Patents Act 1988 (decompilation for interoperability purposes). Any permitted decompilation must be preceded by a written request to OptiTech Automation.
Use the platform in a manner that constitutes an unauthorised access offence or an impairment offence under the Computer Misuse Act 1990, including sections 1 (unauthorised access), 2 (unauthorised access with intent to commit or facilitate further offences), and 3 (unauthorised acts with intent to impair).

2e. Data and privacy

Use customer contact details obtained through the platform (names, email addresses, telephone numbers) for direct marketing purposes without first obtaining a separate, specific, and freely given consent from each customer that meets the requirements of the Privacy and Electronic Communications Regulations 2003 (PECR) and UK GDPR.
Publish, share, or expose personal data belonging to workers, customers, or other Business Owners in any manner that would constitute a breach of UK GDPR or the Data Protection Act 2018.

2f. Intellectual property

Copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the platform, its design, code, documentation, or brand materials, except as expressly permitted in your subscription agreement or by applicable law (Copyright, Designs and Patents Act 1988).
Upload, publish, or transmit through the platform any content that infringes the copyright, trade mark, database right, or other intellectual property rights of any third party.

3. Consequences of breach

Consequences are proportionate and graduated. Minor or first-time breaches typically result in a warning. Serious, repeated, or safety-critical breaches result in immediate termination and may be reported to regulators or law enforcement.

Where OptiTech Automation becomes aware of, or reasonably suspects, a breach of this AUP, we will take one or more of the following steps, having regard to the nature, severity, and frequency of the breach:

Step 1 — Warning and remedy: We will notify the account holder in writing, identifying the suspected breach and specifying the action required to remedy it and the timeframe within which it must be remedied. Where the breach is capable of remedy, we will ordinarily provide this opportunity before escalating.
Step 2 — Temporary suspension: Where a suspected breach is under investigation, where a remedy has not been implemented within the required timeframe, or where the breach presents an immediate risk of harm, we may suspend access to all or part of the platform without prior notice pending the outcome of the investigation. We will notify the account holder of the suspension as soon as practicable.
Step 3 — Termination of access: Where a breach is confirmed, is not remedied within the required timeframe, is repeated, or is of sufficient severity to make continued access inappropriate, we may terminate the account with or without notice depending on the circumstances. For Business Owners, this constitutes termination for cause under the Business Owner Terms. No subscription fee refunds (monthly or one-time onboarding investment) will be issued on termination for AUP breach. The Pledge (30 days notice, no exit fees) does not apply on termination for cause.
Step 4 — Regulatory and law enforcement referral: Where a breach involves, or is reasonably suspected to involve, a criminal offence, a regulatory violation, or a serious risk to public safety, we will report the matter to the relevant authority. Relevant authorities include the Health and Safety Executive (HSE), Gas Safe Register, HMRC, the Home Office (right-to-work violations), the Information Commissioner's Office (ICO), and the police. We are not obliged to notify the account holder before making such a referral.

Exercise of any remedy under this section does not void or limit OptiTech Automation's right to pursue any other remedy available at law or in equity, including civil proceedings for damages.

4. Reporting a suspected breach

If you become aware of another user breaching this AUP — or if you suspect your account has been compromised — please report it to us immediately.

If you suspect that another Business Owner, Worker, or CMS Editor is using the platform in breach of this AUP, or if you believe your account credentials have been compromised or your account has been accessed without authorisation, please report this to us as soon as possible.

To report a suspected breach:

For security incidents or suspected unauthorised access to your account, please email legal@optitechautomation.co.uk with the subject line "SECURITY — AUP BREACH" and include as much detail as possible: what happened, when, and which accounts or data may be affected. We will acknowledge your report within one business day.

Reports made in good faith will not result in any adverse action against the reporting party, even if the investigation concludes that no breach occurred.

5. Governing law

This AUP is governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

This AUP and any dispute or claim arising out of or in connection with it (including non-contractual disputes and claims) shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

OptiTech Automation may update this AUP from time to time. Material changes will be notified to Business Owner subscribers by email at least 30 days before taking effect. Continued use of the platform after that date constitutes acceptance of the updated AUP. The current version is always published at optitechautomation.co.uk/acceptable-use.
