Worker Platform Terms

1. About these terms

You are using the OptiTech Automation platform to manage jobs for a business that subscribes to our software. OptiTech Automation provides the technology; your employment relationship — and every right that flows from it — sits entirely with the business that engages you.

OptiTech Automation is operated by Cristian Moise-Putanu, sole trader, Torquay, Devon, England ("OptiTech Automation", "we", "us"). We provide software-as-a-service tools for trade business management. We are not an employment agency, an employment business, or a staffing intermediary under the Employment Agencies Act 1973.

The business that has given you access to the worker app (the "Business Owner") holds a subscription to our platform. Your access to the app is granted by the Business Owner, not by OptiTech Automation independently. These terms govern your use of the OptiTech Automation worker application and platform.

By accepting these terms on first launch, you confirm you have read and understood them. If anything is unclear, contact your Business Owner or email us at hello@optitechautomation.co.uk before you begin.

2. Your relationship with OptiTech Automation

OptiTech Automation is NOT your employer. We do not set your pay, your hours, or how you carry out your work. Using this app creates no employment, worker, or self-employment relationship with OptiTech Automation.

What OptiTech Automation does NOT do:

  • OptiTech Automation is NOT your employer and does NOT employ you in any capacity.
  • OptiTech Automation does NOT set, calculate, hold, or pay your wages, salary, or any other remuneration.
  • OptiTech Automation does NOT determine your working hours, rest breaks, or working patterns.
  • OptiTech Automation does NOT direct or control how you carry out your trade work.
  • OptiTech Automation does NOT deactivate or suspend your app access except at the instruction of your Business Owner or for a breach of these terms (see Clause 7).
  • OptiTech Automation does NOT guarantee any minimum volume of job notifications or work.
  • You are NOT entitled to claim holiday pay, sick pay, pension contributions, National Minimum Wage, or any other statutory employment benefit from OptiTech Automation. These obligations, where they apply, rest exclusively with your Business Owner.

Your employment status — whether you are an employee, a limb-b worker, or genuinely self-employed — is determined by your actual working relationship with your Business Owner. See Clause 3 below. Relevant law: Employment Rights Act 1996 s.230; Autoclenz Ltd v Belcher [2011] UKSC 41; Uber BV v Aslam [2021] UKSC 5.

What OptiTech Automation DOES provide:

  • A reliable, professionally maintained worker app for managing your job schedule, navigation, and on-site completion records.
  • Clear job information pushed to you by your Business Owner: location, time, job type, and customer contact details for the specific job.
  • Offline caching so your schedule and customer details remain accessible when you lose signal on site.
  • UK GDPR-compliant processing of your personal data on behalf of your Business Owner, with full transparency about what we hold and why.
  • A professional platform that is run by a named, contactable sole trader — Cristian Moise-Putanu — who is accountable for how it operates.

3. Your relationship with the Business Owner

Your pay, your rights, and your working conditions are all determined by the Business Owner who engages you — not by OptiTech Automation. If you have concerns about pay or working conditions, your Business Owner is your first point of contact.

Your Business Owner engaged you — as an employee, a limb-b worker, or a self-employed contractor — before or independently of the OptiTech Automation platform. The OptiTech Automation app is a tool your Business Owner uses to manage and schedule that pre-existing working relationship.

If you are an employee or limb-b worker:

Your Business Owner is responsible for paying you at least the National Minimum Wage or National Living Wage (from April 2026: £12.71 per hour for workers aged 21 and over; £10.85 per hour for ages 18 to 20; £8.00 per hour for ages 16 to 17 and apprentices). Your Business Owner must provide you with a written statement of employment particulars on or before your first day (Employment Rights Act 1996 s.1). Your Business Owner must comply with the Working Time Regulations 1998, including rest break entitlements and the 5.6 weeks minimum annual leave.

If you are genuinely self-employed:

You are responsible for your own tax returns, National Insurance contributions, and any insurance appropriate to your trade. OptiTech Automation is not your client or principal for tax purposes. The Business Owner who engages you for individual jobs is the relevant contracting party.

If you believe your employment rights are being breached, contact: your Business Owner first; then Acas on 0300 123 1100 (free, confidential); HMRC if the concern is about pay; or the Employment Tribunal service for formal proceedings. OptiTech Automation recommends you seek independent legal advice if you are uncertain about your employment status.

4. Platform access and acceptable use

Your Business Owner authorises your access to the app. You must use it only for managing your legitimate job assignments. Misuse is grounds for immediate suspension.

Your right to use the OptiTech Automation worker app is conditional on your continued engagement by the Business Owner and on compliance with these terms. The Business Owner may instruct OptiTech Automation to revoke your access at any time.

You must:

  • Use the app only for managing job assignments made to you by your Business Owner.
  • Keep your login credentials secure and not share them with any other person.
  • Maintain a screen lock on any device you use to access the app.
  • Report any lost or stolen device to your Business Owner immediately so that your app access can be suspended.
  • Report to your Business Owner immediately if you suspect fraud, a data breach, or a safety incident connected to any job managed through the platform.

You must NOT:

  • Access the data of any other worker or any customer beyond what is strictly necessary for your specific assigned job.
  • Copy, retain, or use customer personal data (name, address, phone, email) for any purpose other than completing the specific job to which you have been assigned.
  • Falsify job start times, completion times, work performed, or any other record entered through the app. False records are a serious breach and may constitute fraud under the Fraud Act 2006.
  • Contact customers through any channel other than the one authorised by your Business Owner for job-related communication.
  • Represent OptiTech Automation as your employer, as a guarantor of your work, or as a party to the trade service contract with the customer.
  • Harass, intimidate, or behave unprofessionally towards customers, co-workers, or Business Owner contacts using any platform communication feature.
  • Attempt to access, probe, or interfere with any part of the OptiTech Automation platform beyond your authorised worker account. This may be a criminal offence under the Computer Misuse Act 1990.

5. Your compliance obligations

You are a qualified trade professional. These terms confirm what the law already requires of you. If a certification lapses, you must tell your Business Owner straight away and stop accepting jobs in that trade area until it is renewed.

5.1 Right to work in the UK

By accepting these terms you confirm that you have the legal right to work in the United Kingdom. You must provide right-to-work documentation or evidence to your Business Owner on request and before you commence work. From 31 December 2024, if your immigration status is held as a digital eVisa (rather than a physical document), you must provide your Business Owner with a share code and your date of birth so they can verify your right to work via the Home Office online service at gov.uk/view-right-to-work. You must generate a fresh share code for each employer check; share codes expire after 90 days. If your immigration status changes, or if any time-limited right to work is approaching expiry, you must notify your Business Owner immediately and obtain a fresh share code as soon as your updated digital status is available. Working without the right to work in the UK is a criminal offence under the Immigration, Asylum and Nationality Act 2006 s.24A.

5.2 Gas Safe registration

If you carry out gas work through the platform, you warrant that you are currently individually registered with the Gas Safe Register and that your registration covers the specific appliance category for each job you accept. You will only perform gas work within the scope of your current registration. You will carry your Gas Safe ID card and present it on request at every job site. You must notify your Business Owner immediately if your Gas Safe registration expires, lapses, or is suspended. Carrying out gas work without current Gas Safe registration is a criminal offence under the Gas Safety (Installation and Use) Regulations 1998 Regulation 3 and the Health and Safety at Work etc. Act 1974, carrying a penalty of up to six months' imprisonment and an unlimited fine.

5.3 Electrical competence — Part P

If you carry out notifiable electrical installation work in dwellings in England or Wales through the platform, you warrant that you hold current membership of an approved Competent Person Scheme covering the relevant work category, as required by Building Regulations 2010 Approved Document P. The approved Competent Person Schemes for England and Wales are: NICEIC, NAPIT, ELECSA, BRE Certification, Stroma Certification, and BSI Kitemark. SELECT (SELECT Electrical) is the trade association for Scottish electricians and is NOT an approved Competent Person Scheme for Part P purposes in England or Wales. Membership of SELECT alone does not satisfy Part P obligations for work carried out in England or Wales. You must carry and present evidence of your scheme membership on request. You must notify your Business Owner immediately if your CPS membership expires or lapses. You must not carry out notifiable Part P work through the platform unless your current CPS membership covers the specific category of work required.

5.4 Other professional certifications

You warrant that you hold, and will maintain throughout your use of the platform, all professional certifications, licences, and scheme memberships required by law for the specific trade work you accept through the platform. This includes (without limitation) WaterSafe listing for supply-side plumbing work and a current CSCS card for any construction site work. You will promptly notify your Business Owner in writing if any certification lapses, expires, or is withdrawn for any reason, and you will not accept jobs in that trade area until the certification is reinstated and verified by your Business Owner.

5.5 Public liability insurance (self-employed workers)

If you are engaged as a self-employed contractor, you confirm that you hold public liability insurance appropriate for the trade work you carry out through the platform. You will provide evidence of your PLI cover to your Business Owner on request. If you work as an employee, your Business Owner's employers' liability and public liability insurance policies should cover you — confirm this with your Business Owner if you are unsure.

5.6 Accuracy of records

You will accurately record in the app: job start times; job completion times; a description of the work performed; any issues encountered or materials used (as required by your Business Owner). Deliberately entering false or misleading records is a serious breach of these terms and may constitute fraud under the Fraud Act 2006. It is grounds for immediate suspension of your platform access (see Clause 7).

5.7 Professional conduct on site

You will conduct yourself professionally at all times when at a customer's property or in communication with customers. You will not harass, threaten, or behave abusively towards any customer. You will not use customer contact details obtained via the platform for any purpose beyond completing the specific assigned job. The obligation to keep customer contact details confidential continues after your job is completed and after your engagement with the Business Owner ends.

6. How we process your data

Your Business Owner is the data controller for the information held about you in the platform. OptiTech Automation processes that data on their behalf, following their instructions. Here is exactly what we process and why.

Your Business Owner is the Data Controller for your personal data held in the OptiTech Automation platform. OptiTech Automation acts as a Data Processor, processing your data only on the Business Owner's documented instructions. The legal framework is the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Data we process about you:

  • Identity and contact: your name, email address, and phone number.
  • Employment and trade: your employment or engagement status, your trade skills, and your professional certifications (as recorded by your Business Owner).
  • Schedule and job records: your job assignments, scheduled times, job start and completion records, timestamps, and any notes or photographs you upload via the app.
  • Location data: when you are logged in and your Business Owner has marked you as "on duty", the app collects your real-time GPS location via Mapbox. This is used solely for efficient job dispatch and ETA calculation. Location data is collected only during active working sessions. Retention is set by your Business Owner; it will not exceed the period they specify in their own privacy notice to you.
  • Offline cache: when you lose mobile signal, the app stores your schedule and the contact details for your assigned jobs locally on your device, encrypted where your device operating system supports it. Cached data relates only to jobs assigned to you and is not accessible to other workers.

Your data rights:

Under UK GDPR Articles 15 to 22 you have the right to access your personal data, have inaccuracies corrected, request erasure, restrict processing, receive a portable copy, and object to certain uses. Because your Business Owner is the Data Controller, you should direct rights requests to your Business Owner in the first instance. OptiTech Automation will notify your Business Owner of any rights request we receive about you within 5 business days.

If your Business Owner removes your worker profile from the platform, your personal data will be deleted within 30 days unless the Business Owner instructs a longer retention period for specific records (for example, job completion records for warranty or legal purposes). You may also contact us at legal@optitechautomation.co.uk with any data protection query, and we will direct your query to the right party.

You must maintain a screen lock on any device used to access the app. Report a lost or stolen device to your Business Owner immediately. OptiTech Automation and your Business Owner may remotely revoke app access to a compromised device.

You have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113 if you believe your data rights have been violated.

7. Suspension and removal from the platform

OptiTech Automation is not your employer and removing you from the platform is not a dismissal. App access can be suspended at your Business Owner's instruction or if you breach these terms.

Grounds for immediate suspension:

  • Instruction from your Business Owner (for any reason — the Business Owner administers all worker access).
  • Your Business Owner reports that a required certification, registration, or right to work has expired, lapsed, or been withdrawn.
  • A breach of the Acceptable Use obligations in Clause 4 — in particular: falsification of records, unauthorised access to other workers' or customers' data, or harassment.
  • A credible report of a safety incident or criminal conduct linked to your use of the platform.

Suspension or termination of your app access by OptiTech Automation does NOT constitute: dismissal; termination of your employment or engagement with the Business Owner; or any breach of any employment or worker right you hold. Those matters are entirely between you and your Business Owner. If you believe a removal from the platform has been used to conceal an unlawful dismissal, contact your Business Owner, Acas (0300 123 1100), or the Employment Tribunal service.

If you believe your access has been suspended in error by OptiTech Automation (rather than at your Business Owner's instruction), you may contact us at hello@optitechautomation.co.uk to raise the issue. We will investigate and respond within 5 business days.

8. Our liability to you

OptiTech Automation is not liable for job information errors (that comes from your Business Owner) or internet connectivity issues. Nothing here can limit our liability to you for death or personal injury caused by our negligence.

Nothing in these terms limits or excludes OptiTech Automation's liability to you for: (a) death or personal injury caused by OptiTech Automation's negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot lawfully be excluded or limited under the Consumer Rights Act 2015 or any other applicable law.

Subject to the above, OptiTech Automation is not liable to you for: loss arising from an app failure or outage; internet or mobile connectivity issues outside our control; inaccuracies in job information provided by your Business Owner (the Business Owner is the source and controller of all job data); loss of income or earnings resulting from a change in your Business Owner's scheduling decisions. If job information is wrong, your sole recourse is to your Business Owner.

9. General

These terms are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction. "Non-exclusive" means you retain the right to bring proceedings in any court that has jurisdiction over your employment or worker rights under the Employment Rights Act 1996, Working Time Regulations 1998, or ET Rules of Procedure — these terms do not remove or restrict those statutory rights.

OptiTech Automation may update these terms to reflect changes in the law or the platform. We will notify your Business Owner at least 30 days before any material change takes effect, and a new acceptance prompt will appear in the app. Continuing to use the app after that date means you accept the updated terms.

If any clause of these terms is found unenforceable, the rest continue in full force.
